Договор в интересах слабовидящих людей и проект договора по ограничениям и исключениям в авторском праве для библиотек и архивов: что это означает для развивающихся стран

Аннотация: Доклад на сессии «Международные соглашения, влияющие на выработку национальных программ по ограничениям и исключениям в авторском праве для библиотеки - Комитет ИФЛА по авторскому праву и другим правовым вопросам» Всемирного конгресса ИФЛА (17-23 авг. 2013 г., Сингапур). В докладе обсуждаются современные направления развития законодательства об авторском праве и последствия двух договоров для развивающихся стран - «Договора в интересах слепых, слабовидящих и других лиц с ограничениями чтения» и «Предложений по Договору об ограничениях и исключениях из авторского права для библиотек и архивов».     The paper presented at the Session 209 «International agreements that influence national policy framework for exceptions and limitations for libraries - Copyright and other Legal Matters (CLM)» of IFLA World Library and Information Congress (August 17 - 23, 2013, Singapore). Access to knowledge is the key to socio-economic development in all countries around the world. Without access to information for personal, educational, social, business, political and many other reasons, individuals would not develop or advance beyond their current situations. Unfortunately, for too many people in the developing world, especially persons with sensory disabilities, access to knowledge is an unattainable goal. Their socio-economic circumstances restrict or prevent them from participating in civic, democratic or political activities, and the development process in their countries. Because they do not have access to necessary information to enable them to exercise their basic human rights, they cannot participate equally with those who are privileged to enjoy such rights. Their difficult socio-economic circumstances are exacerbated by draconian copyright laws, which block or seriously restrict access to knowledge. This paper discusses current copyright trends, human rights aspects and the implications of two treaties for the developing world, namely, the ‘Treaty for the Blind, Visually Impaired and Other Reading Disabled Persons’ (TVI), now called the ‘Marrakesh Treaty to Facilitate Access to Published Works for Persons who are Blind, Visually Impaired, or otherwise Print Disabled’ and the ‘Treaty Proposal on Copyright Limitations and Exceptions for Libraries and Archives’ (TLIB). Юридические и технические проблемы сетевого архивирования в Сингапуре

Аннотация: Доклад на сессии «Политика формирования цифровых коллекций в национальных библиотеках: проблемы и возможности» Всемирного конгресса ИФЛА (17-23 авг. 2013 г., Сингапур). Рассмотрены юридические и технические сложности сетевого архивирования, препятствия на пути сбора и управления электронными коллекциями. Проанализированы новейшие международные достижения и проблемы в этой сфере. Выводы и рекомендации сформулированы, исходя из функций Национальной библиотеки, которая обязана поддерживать научные исследования и накопление знаний, в том числе посредством проектных решений, заложенных в сетевом архиве.     The paper presented at the Session 198 «Digital collection strategies at National Libraries: challenges and opportunities - National Libraries» of IFLA World Library and Information Congress (August 17 - 23, 2013, Singapore). Web Archiving in the National Library of Singapore is one of the fundamental actions to ensure the preservation of national digital heritage. By the year 2006, the National Library of Singapore (NLS) has started a Web Archive initiative called Web Archive Singapore (WAS). This paper analyses the legal and technical issues that act as obstacles for the collection and management of the digital collections established through Web Archiving in Singapore. WAS lacks an adequate copyright framework for its digital records management, including long-term preservation and access. From a technical perspective we analyze the latest international developments and challenges of web archival. In both analysis legal and technical, we emphasizes on users of archives as the main leitmotif when focus on solutions. Our final recommendations and conclusions are underlined by the fact that NLS must encourage research and knowledge creation through the support of digital humanities, implementing technical and legal solutions that foster a Web Archive.
